Current zoning does not allow Short-term rentals in a residential district. The Planning Commission meets on the fourth Tuesday of each month at 7:00pm and will be discussing the issues relating to Short-Term Rentals in the Township.

In summary, a property owner’s use of their property as a short-term rental is not permitted in the
R-1 or R-2 District Zoning Classification of the Township Zoning Ordinance. A short-term vacation rental is a commercial use.
Commercial or business uses of property are inconsistent with residential uses of property.

 

Rental Property Registration

 

Ordinance 230

On August 10, 2004 the Valley Township Board passed Ordinance No. 230 which requires all residential rental properties within the Township to be registered with the Township, and allow for inspections of such rental structures.

Steps for Registering *All Properties must be registered by June 1*

  • 1. Obtain a registration form from the Township Office or download online.

  • 2. Return completed and signed Registration form with the applicable fee to:

Valley Township, 2054 N. M-40, Allegan, MI 49010

  • 3. Valley Township will issue a receipt of the completed application (see Section II, Article II)

  • 4. Schedule Inspection appointments if necessary

Note:

If this is a NEW REGISTRATION, an inspection is required immediately. The Owner must contact 269-673-5962 to schedule the inspection.
UPON INITIAL REGISTRATION AND THEN EVERY THIRD YEAR, AT YOUR COST, YOU WILL NEED AN ELECTRICAL AND MECHANICAL INSPECTION SIGNED BY A LICENSED CONTRACTOR .

Application Fee includes inspection $60.00 per year

FINES

-1st Offense $ 75.00 Minimum - $500.00 Maximum
-2nd Offense 150.00 Minimum - 500.00 Maximum
-3rd Offense 325.00 Minimum - 500.00 Maximum
-4th or More Offense 500.00 Minimum - 500.00 Maximum


Additionally, the violator shall pay costs which may include all expenses, direct and indirect, to which the Township has been put in connection with the municipal civil infraction. In no case, however, shall costs of less than $9.00 nor more than $500 be ordered. In addition, the Township shall have the right to proceed in any court of competent jurisdiction for the purpose of obtaining an injunction, restraining order, or other appropriate remedy to compel compliance with this Ordinance. Each day that a violation exists shall constitute a separate offense.
